Terms and Conditions (Individual Users)
Introduction: These Terms and Conditions (“Terms”) govern the purchase and use of the CareTag.uk service by individual consumers. By purchasing a CareTag profile or using the CareTag.uk website (the “Website”) and services as an individual user, you (“you” or “User”) agree to be bound by these Terms. The Service is operated by Health Pros Network Ltd, Company No. 15970093, registered in England and Wales, with registered office at 3rd Floor, 86-90 Paul Street, London EC2A 4NE, UK (referred to as “CareTag”, “we”, “us” or “our”). “CareTag.uk” refers to our Website and related services for hosting emergency contact and medical information profiles.
Please read these Terms carefully before using the Service. If you do not agree with these Terms, you should not purchase or use the CareTag.uk service. We recommend that you print or save a copy of these Terms for your records (you can also find them on our website at any time). These Terms do not affect your statutory rights under UK consumer law.
1. The CareTag.uk Service Overview
CareTag.uk provides a service where individuals can store personal and medical information in an online profile accessible via a secure, unique URL or NFC-enabled bracelet or wallet card. Users typically receive a physical CareTag (such as a card, tag, or bracelet with the CareTag logo and NFC-enabled bracelet or wallet card/ID link) which can be carried on their person. In an emergency, someone (e.g., a first responder) can scan the bracelet with a mobile phone to NFC feature to access to view the user’s profile, which contains the information the user provided (like name, emergency contact, allergies, etc.). Key points about the Service:
- A purchase of a CareTag.uk profile generally includes the creation of the online profile (hosted for one year) and the provision of any associated physical item (if applicable, e.g., an ID tag or card) that links to that profile.
- Profiles are stored on our secure system and are not publicly listed or searchable; they are only accessible through the unique link.
- After one year, the profile will expire unless renewed (see Section 5 on Renewal and Termination). We will send reminders to the email you provided before expiration.
- The Service is intended for personal emergency information purposes only. It is not a medical advice or medical care service, nor a guaranteed emergency response system. It is a tool to aid you and responders; actual emergency response will depend on those who have access to your tag and their actions.
- We strive to maintain high availability of the profiles, but continuous or error-free uptime is not guaranteed. (See Section 9 on Liability for more.)
2. Eligibility and Account Setup
- Age Requirement: You must be 18 years of age or older to purchase the CareTag.uk service for yourself. If you are under 18, a parent or legal guardian must purchase and consent on your behalf. Individuals under 13 are not permitted to use the Service directly; a parent/guardian must set up the profile for any child under 13 (with parental consent) By agreeing to these Terms, you confirm that you meet these age requirements or are a parent/guardian acting for a minor.
- Creating a Profile: To use the Service, you will fill out a sign-up form (currently hosted on Typeform or our Website) providing required information (name, etc.) and any optional medical info you wish to include. You agree to provide accurate, current, and complete information. Providing false or misleading information is prohibited and could be dangerous in an emergency.
- Consent for Sensitive Data: During signup, we will ask for your consent to process any health/medical information you provide. By creating the profile and checking the consent box, you are giving explicit consent for us to use that data to provide the Service (displaying it in emergencies). You can withhold or withdraw consent, but without it we cannot include that information in your profile (which may limit the usefulness of the Service).
- Parental Consent for Minors: If you are setting up a profile for your child or a minor under your care, you represent and warrant that you are the parent or legal guardian of that child and have the authority to consent to these Terms and the processing of the child’s data. You must provide your own contact information as well as the child’s details. We may ask you to confirm your status as parent/guardian during the process. As a parent/guardian, you agree to these Terms on behalf of the child and take responsibility for supervising the child’s use of the Service.
- Account Security: In the current model, user profiles do not require a login to create or edit—edits are done via contacting our support (see Section 4). If in future we provide user accounts with passwords to manage profiles, you would be responsible for keeping any login credentials confidential and for all activities under your account. You should notify us immediately if you suspect any unauthorised access to your account or profile. For now, security of your profile is mainly via the unique URL; do not share that link publicly.
- One Profile Per Purchase: Each CareTag profile purchase is meant for one individual’s information. You should not store multiple persons’ data in one profile (except listing emergency contacts, which you have permission to share). If you need profiles for multiple people, you need to purchase each separately (or use a family/business plan if available).
- Communications: You agree that we may contact you via email (or phone if provided) regarding important information about your profile and service (such as confirmations, renewal notices, or issues). These are service communications, not marketing. (Marketing messages will only be sent if you separately opt-in.)
3. User Responsibilities and Acceptable Use
By using CareTag.uk, you agree to the following responsibilities:
- Provide Accurate Information: You will only provide information that is truthful and pertains to you (or your child/ward). It is crucial that medical details (conditions, medications, allergies) are accurate to the best of your knowledge, as first responders may rely on this. Do not include defamatory, offensive, or irrelevant content in your profile.
- Update Information as Needed: Over the one-year period, if your personal or medical information changes (e.g., you start a new medication or change emergency contact), it is your responsibility to request an update to your profile. You can do so by contacting our support (we currently handle updates by manual request for security reasons). We will make the changes for you promptly. We are not responsible for outdated information if you did not inform us of changes.
- Consent for Third-Party Data: If you include personal information about someone else (for example, naming someone as an emergency contact and providing their phone number), you must have that person’s permission to do so. You should inform them that you are sharing their contact details with us for use in your emergency profile. We will only use that data for the purpose of contacting them in an emergency regarding you. By providing someone else’s data, you confirm that you have obtained any necessary consent or have appropriate authority to do so.
- Keep Your Tag/Link Secure: Treat your CareTag physical item and profile URL as you would sensitive personal information. Do not post your unique URL on public forums or social media. While the link is random, someone with access to it can view your profile. You may share it with caregivers, family, or healthcare providers as needed, but understand the implications.
- No Unlawful or Misleading Use: You agree not to use the Service for any unlawful, fraudulent, or abusive purpose. Do not attempt to use CareTag.uk to store illegal content or anything beyond the intended scope (personal emergency info). You will not impersonate any person or entity or misrepresent your affiliation. You will not use the Service to harm anyone or to violate any law, including data protection laws.
- No Commercial Resale: The individual user service is for your personal use. You agree not to resell, distribute, or exploit the Service or content provided (such as the CareTag, Kit, or website functionality) for any commercial purposes. If you are interested in providing CareTag services to others (e.g., your clients or group), please see our Business Clients section or contact us for an appropriate arrangement.
- Respect Our Intellectual Property: The CareTag.uk site, name, logo, and all content we provide (texts, images, design, software) are protected by intellectual property laws. Health Pros Network Ltd (or its licensors) retains all rights to these. We grant you a limited, non-exclusive license to use the Service and print or download your own profile information for personal use. You may not copy, modify, distribute, or create derivative works from our website content or technology without our prior written consent. Using our trademarks (like the name “CareTag”) must be in line with our brand guidelines (contact us if needed).
- Prohibited Interference: You must not attempt to interfere with the proper working of CareTag.uk. This includes not introducing viruses or malicious code, not trying to hack or gain unauthorised access to any part of the Service or related systems, and not performing any actions that impose an unreasonable load on our infrastructure. Any such activities may result in termination of your profile and possibly legal action.
- Medical Disclaimer: You acknowledge that CareTag.uk is not a medical service or a substitute for professional medical advice. It is essentially a data storage and retrieval service. We do not provide medical advice, diagnosis, or treatment. The medical information in a profile is provided by the user (you) and not verified by us. Always seek the advice of qualified healthcare providers for any medical condition. In emergencies, while the profile can be helpful, first responders will use their judgment and other medical protocols. You release us from any liability for medical outcomes; see Section 9 on Limitation of Liability for more details.
4. Purchasing the Service and Payment
- Ordering Process: To purchase a CareTag profile, you will typically complete our online order form (e.g., via Typeform on our site), where you provide your information and profile data, and then proceed to payment. You must review your order details and correct any errors before submission. Our ordering process will guide you through the steps; please ensure all information is correct (especially email for delivery of confirmation).
- Contract Formation: Your order is an offer to buy our Service. We’ll confirm acceptance of your order by sending you a confirmation email after payment, at which point a binding contract is formed between you and Health Pros Network Ltd for the provision of the CareTag.uk service. If for some reason we cannot accept your order (e.g., due to a problem with payment or unforeseen inability to provide the service), we will inform you and not charge you, or we will refund any payment made.
- Prices and Payment: The price for the Service (e.g., one-year profile subscription and any included physical CareTag) will be the price indicated on our website or order form at the time of purchase. Prices are in UK Pounds Sterling and include any applicable VAT (if we become VAT-registered, we will display prices inclusive of VAT). We use Stripe for payment, so we accept major credit/debit cards and possibly other methods as indicated. Payment is due at the time of order. All transactions are processed securely. You will receive a receipt via email. If a payment fails or is later disputed (chargeback), we reserve the right to suspend or cancel the service unless the issue is resolved.
- Delivery of Physical Product: If your purchase includes a physical CareTag item (such as a card or bracelet) we will arrange for it to be delivered to you. You must provide a valid delivery address. We aim to dispatch physical items promptly, typically within a few days of your order, unless stated otherwise (e.g., if it’s a pre-order or custom item). Delivery will normally occur within 30 days maximum (as required by law) unless you agree to a different timeframe. If there’s a delay, we’ll inform you. Risk in the physical goods passes to you upon delivery. If the item arrives damaged or is lost in transit, please let us know so we can arrange a replacement.
- Activation: Your online profile will be active either immediately upon our confirmation or upon you receiving the CareTag (depending on our process). In most cases, once you’ve completed payment and we’ve confirmed the order, we will create the profile on our system within 1-2 business days.
- Typeform Consent: During the purchase via Typeform, you will have been presented with consent checkboxes and acknowledgments (for this Terms agreement and the Privacy Policy). By completing the purchase, you affirm that you have read and agreed to these Terms and gave the required consents (especially for processing health data). Our records of that consent (timestamps, etc.) may be kept as proof.
- Promotions or Codes: If we offer any discount codes or promotions, they are subject to their specific terms. Only one promo code can usually be used per purchase, and they may have expiry dates. We reserve the right to reject a promo code if it’s invalid or abused.
5. Term, Renewal, and Termination
- Service Term: Each CareTag profile subscription runs for one year from the date of activation/purchase (unless a different term is explicitly stated at purchase). The exact expiry date will be included in your confirmation email or available upon request. We consider the “term” as one year of hosting the profile and providing access.
- Renewal: We do not automatically renew subscriptions without your action (no auto-billing at term end, unless you opt-in separately in future if that becomes available). Instead, we will send you a renewal reminder before your profile expires. Typically, we will email you about 1 month before expiry, and again perhaps 1-2 weeks before expiry, with instructions on how to renew for another year. Renewal will involve payment of the then-current annual fee. If you renew before expiry, your service continues seamlessly for another year from the original expiry date.
- Lapsed Profiles: If you do not renew by the expiry date (or within any grace period we may allow at our discretion), your profile will be considered lapsed. After expiry, the profile will no longer be accessible to view – we may initially suspend it (so anyone scanning the NFC-enabled bracelet or wallet card sees a message that the profile is inactive). Shortly thereafter, we will permanently delete the profile data as described in the Privacy Policy. This means if someone tries to access the link, it will not show your info. We strongly advise renewing before expiry if you wish to continue the service to avoid any interruption. Once deleted, re-activating would require a new purchase and filling data again.
- Termination by You (Cancellation): You have the right to cancel your CareTag.uk service at any time. You can do this by contacting us via email and requesting cancellation. The effect of cancellation depends on timing:
- If you cancel within the first 14 days after purchase (the “cooling-off” period for consumers under UK law), you may be entitled to a refund (see Section 6 on your 14-day right of cancellation). We will also delete your profile if it was already created.
- If you cancel after 14 days but before the end of the term, we will delete your profile and stop the service, but typically no refund will be due for unused time (unless required by law or at our discretion), as the service has been provided up to that point on a subscription basis.
- If you withdraw consent for processing your data (effectively a cancellation of service, since we cannot provide it without processing your data), we will treat that as a cancellation request.
- Termination/Suspension by Us: We reserve the right to suspend or terminate your access to the Service with immediate effect if you materially breach these Terms or if we have serious grounds (for example, if we discover the information provided is fraudulent or if your use poses a security risk). We will attempt to notify you of the issue and may give an opportunity to correct it (if feasible) before termination. If we terminate due to your breach or misuse, you are not entitled to any refund. Additionally, if we cease operations of CareTag.uk entirely, we will inform you and provide pro-rata refunds for remaining full months of service or continue hosting until your term ends if possible. We aim not to shut down without giving users a chance to retrieve or save their data.
- Effect of Termination: Upon termination or expiry, your rights to use the Service cease. You should destroy or securely dispose of any physical CareTag item (since it no longer will be functional – to avoid confusion, you might remove or mark out the NFC-enabled bracelet or wallet card). Sections of these Terms that by their nature should survive termination (such as limitations of liability, governing law, etc.) will continue to apply.
6. Your 14-Day Right to Cancel (UK Consumers)
If you are a consumer (an individual using our service for personal use, not as a business), under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you have a legal right to cancel your order within 14 days of forming the contract, without giving any reason. The following outlines how this works for our Service:
- Cancellation Period: The cancellation period will expire 14 days after the day we email you to confirm acceptance of your order (which is when the contract is concluded). For example, if we confirmed your order on the 1st of the month, you have until the 15th of that month to cancel.
- Extent of Service During Cancellation Period: You acknowledge that when you purchase, we begin preparing and providing the service more or less immediately (setting up your profile, possibly shipping a tag). If you wish to use your profile within the 14-day cooling-off period, that is considered you requesting us to start the service straight away.You still retain the right to cancel within 14 days, but:
- If you requested and agreed that we begin the service during the cancellation period and you have begun to use the service (for instance, your profile was created and accessible, and perhaps you received the tag and have been using it), then if you cancel within 14 days, we are allowed to deduct for the portion of the service provided up to the time you cancel. This deduction will be in proportion to what has been supplied, i.e., a pro-rata amount for the days of service already provided or the setup costs. In practice, since our service is largely front-loaded (we set up and give full access almost immediately), the portion used could be substantial. We will inform you of any deduction. For example, if you cancel on day 7, we might charge for 7/365 of the annual fee, or an administrative fee for setup, as allowed by law.
- If the service was fully provided within the 14 days (unlikely in our case, as it’s a year-long service, but hypothetically if we had a one-off digital download, etc.), you may lose the right to cancel once the service is fully performed with your agreement. With CareTag, it’s an ongoing service, so this doesn’t exactly apply – you can cancel anytime in first 14 days with relevant deductions as above.
- If you received a physical product (like a tag) as part of the service, and you cancel within 14 days, you may be required to return that product (in good condition) or we may deduct the cost of it if not returned.
- How to Cancel within 14 Days: To cancel, you must inform us of your decision unequivocally before the 14-day period has expired. You can do so by:
- Emailing us at support@caretag.uk with the subject “Cancellation Request” and providing your name, order date, and a clear statement that you wish to cancel.
- Alternatively, you may use the model cancellation form (found in the Regulations or we can send you one), but it’s not obligatory. An email or written letter that includes the information will suffice.
- You can also call our support number if provided, but we will likely ask for a written follow-up for our records.
- We will acknowledge receipt of your cancellation by email.
- Refund Process: If you cancel within the 14-day cooling-off period, we will process your refund as soon as possible, and in any case within 14 days of receiving your cancellation notice (or within 14 days of receiving back any physical goods we sent you, if applicable). The refund will be made to the same payment method you used, unless otherwise agreed. If a deduction for used service or damage to returned goods is applicable, we will inform you of the final refund amount.
- This Section 6 is in accordance with your rights under the Consumer Contracts Regulations 2013 and does not affect other cancellation terms outside the 14-day window.
7. Refunds and Returns (After 14 days)
- After the 14-day statutory cancellation window, refunds are generally not provided except at our discretion or as required by law. Our service is a digital content/service which is provided continuously after purchase. If you cancel after 14 days (or request early termination), we are not obliged to refund unused months. However, we aim for customer satisfaction, so if you have special circumstances (e.g., you found the service not useful and it’s relatively soon after purchase), please discuss with us – we may offer a goodwill partial refund or other solution on a case-by-case basis, but this is not guaranteed.
- If you experience any technical issues or our service fails to meet the standards promised (for instance, if the profile was unavailable for a significant time due to our fault), you may have rights under the Consumer Rights Act 2015 for digital services. We would either re-perform the service (fix the issue) or, if that’s impractical, give an appropriate price reduction or refund for the affected period. We are committed to fulfilling our obligations and will work with you to resolve problems.
- If a physical product included in the service is faulty or not as described, you have rights to a repair, replacement, or refund under the Consumer Rights Act. For example, if your CareTag bracelet arrives broken or illegible, let us know and we will replace it free of charge. If we cannot replace, we will refund the portion of the price applicable to that item. You must inform us of such issues within a reasonable time.
- To arrange returns of faulty goods, contact our support for instructions. Usually, we’d provide a return address or may even not require return for low-cost items and just send a new one. We cover return shipping for faulty or wrong items.
8. Service Use in Emergencies and Disclaimers
- Emergency Data Use: By using CareTag, you understand and agree that any person who obtains your CareTag device or link can view the information on your profile. It is your choice what information to include. We recommend including only information that is relevant in an emergency and you are comfortable sharing under those circumstances. Do not include highly sensitive info that isn’t necessary (e.g., financial info, identification numbers) on the profile. We are not responsible for any misuse of information by someone who gained access to your profile through possession of your tag or link – for instance, if you lose your tag and an unknown person views it. We do our part by not indexing the profile and keeping the URL obscure, but the nature of the service is to allow open access via that key.
- No Guarantee of Use by Rescuers: We do not guarantee that medical personnel or others will recognise or use the CareTag in an emergency. We will, however, promote awareness of our product. Many paramedics or first aiders might look for medical ID jewelry or emergency info on a phone; our solution is one of many. We encourage you to inform family or caregivers about your CareTag so they can mention it to responders if needed. We cannot be liable if a first responder fails to notice or check your tag.
- Data Accuracy and Medical Outcomes: We do not verify the medical information you provide. Therefore, we cannot assure its accuracy or completeness. It’s the user’s responsibility to ensure information is correct. We also cannot assure how a medical professional will interpret or act on your information. For example, if you list a medication, a paramedic might use that info, but we are not liable for their decisions. The Service is a passive conduit of information you provided.
- Downtime and Accessibility: While we aim for 24/7 availability, the Service may occasionally be unavailable due to maintenance, outages, or internet issues. We will try to schedule maintenance at low-impact times and keep it minimal. However, by the nature of technology, we cannot guarantee 100% uptime. In a scenario where the site is down at the exact time of an emergency, we disclaim liability for any consequences, but we will certainly strive to avoid such scenarios and have redundancies. We recommend you also carry traditional information (like an engraved medical ID for critical allergies as backup).
- Third-Party Services: CareTag.uk may contain links or integrations to third-party websites or services (for example, if a hospital uses the info or if our emails include links). We are not responsible for third-party content or services. Using Stripe for payment is subject to Stripe’s terms; using any link from your profile (like if you list your doctor’s website) is not under our control. We do not endorse or take responsibility for third-party websites.
- Website Content: Any general content on our website (like blog articles, FAQs) is for information only, not professional advice. While we try to ensure accuracy, we make no warranties that such content is up to date or error-free.
9. Limitation of Liability
IMPORTANT: Nothing in these Terms limits or excludes our liability for: death or personal injury caused by our negligence, or fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law (for example, under the Consumer Rights Act 2015). Your statutory rights as a consumer are not affected.
- Exclusions: Subject to the above, to the maximum extent permitted by law, Health Pros Network Ltd (CareTag) will not be liable for:
- Any indirect, consequential, or special losses. This means we are not liable for losses that were not reasonably foreseeable by both parties at the time of contract, such as loss of opportunity, emotional distress, or third-party losses.
- Loss of data or information, since the purpose of our service is to store data, we strive not to lose it; however, if data is lost or corrupted despite our precautions (and we haven’t already provided a backup to you), our liability will be limited to measures to restore the data or the value of the service, as appropriate.
- Any loss arising from: misuse of your profile by someone you gave access to or who obtained your tag without your knowledge, any inaccurate information provided by you, or any failure by an emergency responder or other third party to correctly utilise the information.
- Any outcomes in medical emergencies. We do not provide medical care, so we cannot accept liability for medical decisions or outcomes. The Service is a tool; ultimate responsibility for medical treatment lies with medical professionals and circumstances. You acknowledge that emergency outcomes can depend on many factors beyond our control.
- Service Liability Cap: Except for the scenarios we cannot limit (noted above), if we are found liable to you for any claim arising from these Terms or your use of the Service, our liability shall be limited to the amount you paid for the Service in the 12 months preceding the event giving rise to the liability. For example, if you paid a £20 annual fee, our maximum liability for all claims would be £20. If you have used the service for free (in a trial or similar), our liability will be limited to £0 in such case.
- No Warranties: We provide the Service on an “as is” and “as available” basis to the extent permissible by law. While we endeavor to maintain a high-quality service, we do not warrant that the Service will meet all of your expectations or that it will be uninterrupted or error-free at all times. We do not make any guarantees about the accuracy, reliability, or completeness of any content (including profile info, which as noted depends on user input).
- Force Majeure: We are not responsible for failures or delays in performing our obligations due to events outside our control (“force majeure”). This includes events such as natural disasters, war, acts of terrorism, strikes, epidemics, power or internet outages not caused by us, or government restrictions. If such events occur, we will do our best to keep the service running or resume service as soon as possible, but there could be interruptions for which we aren’t liable.
- Indemnity: This is not typically heavily applied to consumers, but for completeness: To the extent allowed by law, you agree to indemnify and hold harmless Health Pros Network Ltd and its directors, employees, and agents from any claim or demand (including reasonable legal fees) made by any third party due to or arising out of your violation of these Terms or your violation of any law or rights of a third party in relation to your use of the Service. For example, if you provided someone’s data without permission and they bring a claim against us, we may seek to have you cover those damages/costs. This clause does not apply to the extent it would be deemed unfair or unenforceable under applicable law (we understand consumer contracts have limits on indemnities).
10. Privacy and Data Protection: We take your privacy seriously. Our use of personal information is governed by our Privacy Policy (see above or on our site). By agreeing to these Terms, you also acknowledge our Privacy Policy. Key points:
- We will process your personal and health data in accordance with UK GDPR and only for providing the Service, as detailed in the Privacy Policy.
- We require explicit consent to handle health data and you have provided that consent in the sign-up process. You may withdraw consent as discussed, but that may require terminating the service.
- We have security measures to protect your data (described in the Privacy Policy), and you have rights regarding your data.
- We will not use your data for marketing without consent, and we do not sell your data.
- If you have any privacy-related queries or requests, you can contact us as per the Privacy Policy contact info.
11. Changes to Terms: We may update or modify these Terms occasionally, for example to comply with new laws or improve clarity. If we make significant changes, we will notify you via email or via a prominent notice on our Website. Changes will not retroactively affect any provision that resulted in a dispute; they will apply going forward. If you do not agree to the revised Terms, you should stop using the Service and can request cancellation (with a pro-rata refund for any full months remaining, if applicable). Continuing to use the Service after the effective date of updated Terms constitutes acceptance of the changes. The “last updated” date at the end indicates when the Terms were last revised.
12. Miscellaneous
- Governing Law: These Terms are governed by and construed in accordance with the laws of England and Wales. This means that the contract for the purchase of the Service and any dispute or claim arising out of or in connection with it will be governed by English law.
- Jurisdiction: You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction to settle any disputes or claims. If you are a resident of Northern Ireland, you may also bring proceedings in Northern Ireland. If you are a resident of Scotland, you may also bring proceedings in Scotland. We primarily anticipate serving UK customers, so this should cover it.
- Entire Agreement: These Terms, along with the Privacy Policy and any other documents expressly referred to in these Terms, constitute the entire agreement between you and us regarding the Service. They supersede any prior agreements or communications. You acknowledge that you have not relied on any representation or warranty not set out in these Terms when entering into this agreement.
- Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable by a court or regulator, that provision shall be deemed removed (severed) from the Terms, and the remaining provisions shall remain in full effect. We will work to amend any invalid provision in a valid manner that closely achieves the intent of the original.
- No Waiver: If we do not insist immediately that you do something you are required to do under these Terms, or if we delay in taking action against you for a breach of these Terms, that does not mean we waive our rights. Any waiver of rights is only effective if in writing by us.
- Transfer of Rights: You may not transfer or assign your rights or obligations under these Terms to anyone else without our prior written consent. - Third Party Rights: These Terms are between you and us. No other person shall have any rights to enforce any of their terms (except that if you bought a profile for a child, that child may have rights as a data subject, etc., but these contractual terms as such don’t grant rights to others).
